U.S. border cop charged with murdering Mexican

BISBEE, Arizona (Reuters) - A U.S. Border Patrol agent must stand trial for murder in the shooting of a Mexican man trying to enter the United States, an Arizona judge ruled Monday in a case that drew criticism from Mexico.

Agent Nicholas Corbett was charged in April with four counts of homicide in the January 12 shooting of Francisco Dominguez Rivera shortly after he crossed the border illegally on a stretch of desert between Douglas and Naco.

Cochise County Justice of the Peace David Morales ruled the evidence supported lesser charges of second-degree murder, but threw out charges of first-degree murder, which supposes premeditation.

The ruling followed a preliminary hearing that heard evidence from three illegal immigrants present at the shooting, a pathologist, county sheriff's detectives and two Border Patrol supervisors.

No date was set for Corbett's arraignment.

Following the killing, Mexico's Foreign Ministry complained of "disproportionate violence" and instructed the Mexican Embassy in Washington to investigate the circumstances.

Last year, border police captured 1.1 million undocumented immigrants crossing over the border from Mexico and recorded a soaring number of attacks on agents.

Lawyers for Corbett argue he shot Dominguez Rivera in self-defense after he was threatened with a rock.

I would back up as much as i can and look for other options. And if i am cornered that i really have to fear for my life (don't forget he had a stone and not an AK47) i would shoot his legs and arms. An agent i would say has the training for it. What do you say?

Actually i know it first hand. In Greece there is military draft. As i soldier i we had to control the border to albania. And shooting was only permited if a gun was there. We were not to shoot if we would get attacked with knife if there were more than 2 of us present. And again........ first legs and hands.

Yes and no.

Lets start with the basic premise here. Is the "Mexican" an illegal and thus a criminal or was he a legitimate tourist?

If he was illegal and a criminal, does that place him in a different light in respect to the border agent?

Admitting we are dealing with a criminal, one that is threatening me with a rock, the shooting is justified.

Had the "illegal" been able to disarm the agent and kill him, you would not be here???

Ah, the 'flesh wound' tactic. Lovely. I was trained - and I assume every academy in the nation is the same - that if your life was in danger and you pulled your gun, be prepared to shoot. The silhouette we used didn’t contain limbs. We were trained to shoot into the chest. Period, end of threat. Now I'm no John Wayne, but if an illegal comes at me w/a rock, and I feel my life is in danger, he goes. This as it should be.

I know what you are trying to say, but the law is clear - if you shoot, you shoot to kill, not maim.

Most excellent advice for the private citizen as well, for multiple reasons.

Besides in a panic situation trying to hit an arm or leg is something only a very well trained person could even hope to do.

Best go for center of mass and unload the gun --- and be sure you have no other option.

Tell the cops "I feared for my life and I only wanted to stop him".

The best way to handle a rock thrower is to charge him, removing the distance the rock needs to gain the momentum needed to hurt someone. That is what I wish this official had done. I am not happy to see someone die over such a minor thing as this.

Look, here's a really simple example: where I grew up, there was a government piece of land by me. As a kid, I really wanted to snoop around there, and get inside. But in doing so, I knew I would get a butt full of lead. So I didn't do it.

If there is a border, and military or police there, you get shot. It's really that simple.
