A homeowner was arrested after a burglar plunged from the balcony of his top-floor flat.

The intruder suffered head injuries and is fighting for his life after falling around 30ft on to a concrete path.

Later police arrested the owner and are investigating whether the intruder was pushed.

The incident happened early on Monday when Patrick Walsh, 56, awoke to find the 43-year-old man rifling through his flat.

They argued and the confrontation moved towards the rear window of the flat.

It is believed the intruder then smashed the window and clambered out on to a narrow ledge and fell to the ground.

Mr Walsh phoned police and at around 6.30am officers found the man on the ground outside the smart Victorian apartment block in Chorlton-cum-Hardy,

He was taken to hospital with serious head injuries.

Officers arrested Mr Walsh on suspicion of causing grievous bodily harm with intent and are trying to establish whether the intruder was forced out of the window.

The arrest is expected to fuel arguments about the rights of householders to defend themselves against burglars.

The issue has been high on the law and order agenda since farmer Tony Martin was jailed for shooting dead a burglar in 1999.

Following the Martin affair the Crown Prosecution Service and the Association of Chief Police Officers said any householder can use reasonable force to protect themselves or others, or to carry out an arrest or to prevent crime.

Yesterday Mr Walsh, who was given bail pending further inquiries, refused to speak about the incident.

But his solicitor Victor Wozny said: "My client is not at liberty to say anything because he is under police bail.

"However we appreciate that the public view might be that this is a man arrested in his own home defending his own property."

A neighbour said: "Police arrived in what seemed to be minutes and were there for the whole day.

"It's shocking to find out what has happened but people shouldn't break into other people's houses."

Another resident said: "I presume we will have to respect the burglar's rights while his victim has the nightmare of court hanging over his head. It all seems so unfair."

A spokesman for Greater Manchester Police said they had been called following reports that an intruder had fallen from a top-floor flat.

A 56-year-old man had woken up to find a man in his flat.

"Following an exchange of words, the alleged burglar was found unconscious on the pavement outside the flat.

"It is believed that he had fallen from the fourth-floor window."

He said the man is 43 and lives locally and inquiries are continuing to establish the circumstances surrounding the incident.

Mr Walsh was later released on bail until November. If charged and convicted he could face a life sentence.

When I lived in Boston, I read of many people in jail for defending themselves. In one case a man broke into a locked house. The woman shot the man dead because she said the man whom she knew to be a sex offender would not let her leave with her young daughter. The prosecution said she should have left her daughter in the house with the sex offender and waited for the police.

At about this same time I knew a man whose brother just entered his apartment and locked the door. Two men using an axe broke down his door, broke in, robbed him and assaulted him. Just for fun they broke 3 of his 4 limbs plus other bones. He was black was were the perpetrators. The police were called and took 45 minutes to respond.

Is it just me or is there more insanity anmongst the voters and in the legal system as the Jewish population increases?

We had a guy go to jail years ago in Portland, Oregon for getting sick and tired of losing his truck tape player and rigging a booby trap to shoot the next thief with shotgun buckshot.

The perp also had a good payday from his lawsuit on this incident too. So one must be very careful in how they approach getting even in situations like this one.

We also had a homeowner in NE cut a jockeyboxer in half with a shotgun when the kid charged the obviously armed homeowner.

The charges were dropped.

Here in OR, you can pretty much do as you wish so long as its obvious.

Yep. I know that after I had a gang of young men charge me at a MAX lightrail stop with intent of strong arming my very expensive bicycle away from me,(I bolted to the Sunset highway and rode the wrong way on the shoulder to escape) I started carrying a concealed firearm in Portland, Oregon once more. (I do have a permit.)

It's amazing how polite and oriented to leaving one's presence a criminal gets when you pull a five shot snub nosed revolver on him/them.

(And if I pull it, I am 95 percent on the way to shooting them. Never pull a gun out unless you intend to kill with it given no othe choice.)

I personally believe that if someone breaks into your house, regardless of intention, you have the right to summarily execute them on the spot.

Here's why.

If they break into your house, and you do nothing, you are opening yourself up to injury or murder, even if it's a non-violent break in, you have no idea as to what their intentions are.

Then, there's the fact that if you offer no resistance, and the perpetrators aren't caught, THEY WILL RETURN.

It's so much easier, and you'll have more peace of mind if you simply summarily execute these people on the spot, without hesitation. Wait until they are deceased, and then call the cops. Then act as if you were in fear of your life.

It's time for Americans to put a stop to crime, because the police can only do one thing, investigate what happened after a crime is committed. They cannot stop crime from happening.

Dying for old bastards, and their old money, isn't my idea of freedom.

I I ever pull a gun I am pulling the trigger till the pops stop. But I really have to have a major reason to pull it.

A rash of armed robberies here have left the cops in a tizzy cause they cannot seem to do much about it, the perps are gone long before they can get to the place of action.

I don't have a CC but lately (after being horribly, violently robbed by four armed gunman) I have been doing the bank runs with my hammerless .38 sitting on the seat next to me, something I never used to do for fear of the hassle getting pulled over for whatever and having the cops slamming my face on the ground for having a gun.

The balance has tipped. I am fully ready to not be a victim to these deranged people. Take the money, sure, point a gun or knife or rock threaten my physical well being - the lead's flying if I get a half chance. And I am NOT shooting to maim. Center of Mass followed by a head shot if I can manage it.

Doing everyone a favor. If these people will do this to us, an openly armed Liquor Store, what might they do to your mothers or daughters in a parking lot at night???

This was the rule of accepted law in most of the ancient times that I am aware of.

If you approached a house at night, the custom was clear - you made a lot of noise to announce your presence.

If you were caught sneaking around the worst was (quite rightly IMHO) assumed and you were delt with accordingly.

My buddy in CO Springs told me that CO concealed-carry permits were pretty good and easy to obtain, outside of Denver, which for some reason thought that city law trumps state law.

I'd go invest a day in getting one, if I were you. We put all of our employees through the course.

Here in MN we were told to shoot to kill, then let the cops and the jury figure it out. The only reason necessary is to believe that we are "in danger of great bodily injury or death" or that someone else is/would be through our inaction.

I have thought about setting up some fake ones around our main safe, just to make the reprobates think if it was really worth it. Unloaded shotguns with wires etc, cause at least a few of the after hours robberies have involved delivery men ( I guess) who obviously knew the inside score.

"MAN KILLING TRAPS INSIDE" as a sign on the swamp cooler ( a typical entry point, would make me think twice about the robbery. But they don't think, as I am sure we can agree on.

I had to do similar things down in California. Pulled a broadsword before I had a pistol, though, when some twink was trying to break into my apartment. Now THAT causes someone's eyes to bug out in a hurry. They certainly aren't expecting that! I don't think I've ever seen someone run away quite so fast before.

As my Grandfather used to say, "They can outrun me, but they can't outrun a bullet."

Let's hope you never have to use it.

Yup. Don't always expect a weapon to make an idiot back down. I had to help give the boot to some meth heads that were renting a unit where I used to work. It was late at night and they were good and loaded. All 5 of them picked a fight with a construction worker who was helping improve the property at the time.

I fired one shot into the ground with a SIG P220 in .45. 4 of the 5 meth heads quickly backed off. The 5th one wanted to take me on bare handed and was only stopped by his friends...even then it took them five minutes to talk him out of it. They quickly packed up and left, but had things turned sour I would have opened up without hesitation.

I had put all innocent people involved behind me and already figured out which order I was going to shoot them if they did'nt do exactly as I said and leave.

And if anyone is wondering why no one called the police, allow me to explain. The police and courts in Colorado are the most worthless fucks this side of the rockies. There is no law here, only the illusion of it.

I read an article -- don't know if it's true or not -- in which the owners had a sign on the window -- "Go ahead and break in. We have several snakes loose inside." (They didn't.)

The robberies stopped.
