My Father in law, a beautiful kind man, died about a year ago. My wife's mother was devastated. She went to a grief counseling class and soon was wooed by John whose wife died a few days apart from Lois'. She is 79, he was 83.
Soon they married, and John assured me all was taken care of - if he died Lois would have full access to the house they had just bot with no encumberences, and if she died he would likewise.
Things looked GREAT. Lois got out of her house that would have only constantly reminded her of her loyal husband of fiftytwo years and she got a husband to irritate her and keep her alive and doing things - that's alot folks.
SOOOOO - he sold his plain house and she sold her plain house and together they bot a new 3000 ft pretty nice house in Sulphur Louisiana. And John bot her some expensive furniture to put in the house.
Ok We were good with it. Her living alone in her old house and him living alone in his old house is typically early death. So all the aggravation of moving them fell pretty much on me and my saintly wife.
Things are whipped cream and cherries for ten months. John is very pleased with Lois and decides to give her $100,000 for her birthday. So on May 29 he makes out a check for said sum and they deposit into their joint account. The check says "Pay to the order of : LOIS. We have a bank copy of the check and that is what it says.
Then John starts feeling bad - he had a rough time in the Sulphur LA hospital (DO NOT UNDER ANY CIRCUMSTANCIES GO TO THE SULPHUR LA CALCAM HOSPITAL FOR ANY REASON IF YOU WANT TO LIVE)- sUCIDIAL IT SEEMS TO BE A GOOD CHOICe.
John has a major stroke. He asks for his lawyer, as he realizes his will is out of date. His attorney meets with him on Friday afternoon, for about an hour.
I know what he tells him " keep my kids away from Lois, let her stay in the house and I want her to have the $100,000 I gave her".
He also told that to several of his children to there faces.
The lawyer said Ok, I have this transcript, I will have it typed up over the weekend and on Monday I will come here and have John initial it.
Monday comes and goes and there is no lawyer.
John dies Tuesday at three in the aym.
So Lois is now being forced out of her house because the per nup contract supersecds natural right of userfruct (the right of a surviving spouse to have use of a house after their spouse dies) ( Think "use of the fruit"))
Well the vanellia pre nup contract they entered into did NOT give Lois right of userfruct, sooooo
now she is being kicked out of the house by one member of the estate and the whole thing SUCKS.
So what I recommend, if you have a parent who dies and if the survisor wants to re marry - Horray.
Either understand how all this works - unlikely. I am sick of it all.
