A copy of the actual DOJ complaint against SAPF can be found at this website: http://www.usdoj.gov/tax/KotmairComplaint.pdf
There are a great many problems I see with the complaint. Basically there are a great many mischaracterizations and items taken out of context. A few items are basically correct, but which are perfectly legal. There is also the matter of their attempts to find fault with SAPF operations which were already dismissed with prejudice in 1996. Again, this complaint is civil in nature and not criminal, so they are not alleging any crime is being committed.
Since complaints can be modified, I'll refrain from offering any commentary on specific defects for the time being.
It is now expected that John Kotmair will be formally served with notice of the filing. When that happens is up to the DOJ.
