Robert Remini makes an interesting -- and compelling -- argument that the British would not have returned New Orleans (or the rest of Louisiana or the Gulf Coast) had the British won at New Orleans.

According to this argument, the "status quo" provision of the Treaty of Ghent did not include the US retaining Louisiana because the purchase from Napoleon was illegal -- the Treaty of San Ildefonso by which Spain gave Louisiana to France expressly provided that Spain retained first right to repurchase it. There was even less right for the US to hold what is now the Alabama and Mississippi Gulf Coast (and Louisiana between Ponchatrain and the Mississippi border); the US seized the land illegally during the war with the bald assertion that the land was part of the Louisiana purchase).

I didn't do as well as I would have liked to. But that is a normal response to a test like this.
