RE: Department of Justice Range Use Suspension

Attorney General Lockyer:

The Board of Directors of the Folsom Shooting Club (FSC) has directed me to advise you, in writing, that Department of Justice staff, while acting in their official capacity, are suspended from using the Sacramento Valley Shooting Center (SVSC). The FSC is concerned that your staff will further your efforts regarding AB 352 and SB 357 while using our facility.

The FSC is a non-profit corporation that owns and operates the Sacramento Valley Shooting Center (SVSC) located in Sloughhouse, California. Founded in 1952, the FSC has approximately 1000 members. At over 880 acres, the SVSC facility is one of the largest and best-equipped privately owned shooting ranges in the United States.

The FSC has always had a close working relationship with law enforcement agencies. Many club members are currently serving, or are retired peace officers. At the direction of the FSC Board of Directors, use of the SVSC facility has been offered to law enforcement organizations at nominal cost. Law enforcement personnel from various units in your department use the SVSC while they are on duty.

The Board of Directors was recently made aware of your energetic support for both AB 352 (Koretz) and SB 357 (Dunn). AB 352 would require the microengraving of identifying information on handguns and SB 357 would require that identifying numbers be placed on handgun bullets and packaging. We believe that neither bill would be a significant crime-fighting tool; but that both would harm consumers and the firearms industry.

As a result of the Board’s concerns, we monitored the Senate Public Safety Committee hearing on April 26, when you and Senator Dunn presented SB 357. As currently constructed, SB 357 would require that handgun ammunition (including .22 rimfire), sold after July 1, 2007, must have an identification number. Existing ammunition affected by this legislation, without the required identification numbers, would subject the owner to arrest if the ammunition is possessed in a "public place". The definition of "public place" is so broad that it includes driveways and front yards.

There are many reasons to dislike SB 357. In the unlikely event that ammunition makers could meet the requirements of the bill, the cost of ammunition would skyrocket. More importantly, we were appalled by the caviler manner in which you, California’s Chief Law Officer, and Senator Dunn described your willingness to confiscate legally owned private property and make criminals of its owners. As you have defined "handgun ammunition", millions of owners would be put at risk and the amount of lawfully owned ammunition subject to confiscation could easily surpass one billion rounds.

It is with deep regret that the officers of FSC have been moved to take this action. We sincerely appreciate the role that law enforcement provides to our society in keeping all of us safe. However, we will oppose, to any extent necessary, your attempts to deny us the ability to enjoy our sport. Any of your employees who are members of the FSC are welcome to use the SVSC provided that such use does not occur while they are on duty for the Department of Justice.
