Dedicated to; The intimidated and misled American taxpayer who can now emancipate himself, but only if he is willing to accept that he has been deceived by the terms of the Constitution and recognizes that having lived under it, he cannot truly defend it as being sacred nor in his best interest. This book provides the author's findings and opinions based on research and analysis of the Constitution as shown herein. This information is given as a legal service because it exposes the fraud of the establishment and employment of the U.S. Constitution, which is used by lawyers as the basis of the Amreican legal system. Lawyers, who take the Constitutional oath when admitted to the bar, become themselves engaged in the unauthorized practice of law for which they prosecute others. The American Bar Association is a private association of lawyers. It has no business to dictate the requirements for admission to legal practice in the united States. By their actions, they have destroyed the concept of a Republican form of government for their system requires judges, districts attorney, and others to be lawyers. All public officiers in all three branches of government are open to lawyers. Only those who fully conform to the dictates of the American Bar Association can become first-class citizens. All other people are denied a voice in the judicial system as judges, prosecutores, etc., making all non-lawyers second-class citizens. Is it any wonder that the average American feels helpless and frustrated by court-made rules and decisoins? In all civilizations, why must the great majority be pushed to the brink before they open their minds to the dangers that surround them? Self-published in 1995 by the author. Introduction In August 1969 about 10 of us retired from the Rochester, New York Police Department. A Committee..... This brought back memories of my first days on the Department. I was young, proud, and eager to prove myself, but like most people unexposed to the "real" world and politically quite naive. ... Never did I realize that my quest for honesty and justice as a police officier was to cause me, my family, and my friends grief in many ways. I lost earned civil service promotions because of the politicians who run the states and cities. When you head the civil service promotion list, you can be passed over until the list expires, or even placed on trumped-up charges and suspended. They managed to do all of this to me when promotional appointments came up. Later on in my police career, I used the Constitution to go on the offensive. City officials then begged and even atempted to bribe me to take promotions. I had the satisfaction of refusing all of them. At the moment of my retirement, my thoughts took me back to the many times of speaking up to judges, districts attorney, and defense lawyers and finally challenging the entire system of criminal jurispudence. This earned me the hatred of the judiciary and changed the course of my entire life because I had to prove clearly that their laws and system did not serve justice and were in violation of basic rights. The state legislature, composed of a majority of lawyers, was also abusing its authority in enacting laws that encouraged litigation. I realized that I had a real challenge and would have to get to basics by studying the United States Constitution and the New York Constitution in depth. In case after case, abuse after abuse, I saw the vital importance of maintaining a proper separation of powers. After forty-seven years of research, I found that our federal and state constitutions could not work without a strict and guarded separation of powers. I had made many arrests, alone or in ........ Beyond my concerns for the immediate families of the victims, I sensed that these crimes were small im comparison to the crimes past and present committed by the American bench and bar against the American people. This book will show how the judiciary has managed to unlawfully secure great wealth and power from the very beginning, starting with the Constitutional Convention of 1787. The American people have gotten an erroneous and distorted version of what actually went on at that convention. Of the fifty-five men assembled in Philaelphia, a majority of thirty-four were lawyers; these lawyers were working for a constitution and government to serve themselves, not the people. ... This book is one of the better books I have in my extensive library, and one of the last that I would give up. I recommend that anyone who is considering voting, or, working in 'an' election, read this book BEFORE they do anything! It will explain to you exactly how America has been lost to the common man, and, woman. Book Review: The CONstitution That Never Was by Ralph Boryszewski Ralph Boryszewski is an old curmudgeon. He is also an old cop. He sounds to me like the type of cop that was once called a *peace officer,* rather than *law enforcement officer.* His examination of the Constitution, as the CONstruction of the title might indicate to you, is rather unconventional. And, to my view, right on target. In his opinion, the body of the Constitution is a con job perpetrated on the American people. It is Mr. Boryszewski's opinion that the Constitution is null and void on its face, and has never had a shred of authority, from its inception by a rogue convention to the massive abuses carried out under its auspices today. To begin with, Mr. Boryszewski doesn't like lawyers-- and I am being gentle. Ralph isn't. To the best of my knowledge, the only lawyer to escape his wrath is Lysander Spooner, who is about as far removed from *lawyerism* as any lawyer I have ever heard of. You may be more familiar with Mr. Spooner for his reputation as an *anarchist.* You are probably aware that the Constitutional Convention was heavily dominated by lawyers, and was adamantly opposed to ANY inclusion of a Bill of Rights, particularly one introducing the document and thus shackling the demon-child being birthed-- central, *federal* government. The Bill of Rights which was eventually *appended* to the Constitution is composed of *articles.* These articles, as Ralph points out, don't AMEND any portion of the body of the Constitution. The closest they come is to RESTRICT congress in their ability to pass laws by declaring the rights of the OWNERS of the country, the people. Ralph points out that the Constitution is an agreement among the states; the Bill of Rights is a statement OF THE PEOPLE, setting ground rules for behavior of the federal government AND the states which formed. it. It is his assertion that the Bill of Rights is separate and complete within itself, NOT A PART OF the Constitution at all. He asserts that the Constitution is inferior to the Bill of Rights, and if you examine closely our present situation, it would certainly appear from their actions that the oaths taken by our elected officials and judges and *law enforcement officers* to uphold and defend the Constitution certainly excludes the provisions and limitations upon government set forth in the Bill of Rights. Ralph asserts that lawyers planned it this way; he asserts that there is NO separation of powers, since lawyers, who owe fealty to the courts, wrote it; lawyers served in the legislatures which approved it; lawyers serve in the legislatures, state and federal, which write laws under its *authority.* He points out that U.S. Attorneys, and the Attorney General, are sworn to the courts. Therefore, the bar associations, the trade union for the lawyers, are actually in control of the judicial, the legislative, and the executive branches of government. Thus, there is NO separation of powers. He points out that under the *rules of the courts,* all indictments must be signed by a U.S. Attorney, thus removing any possibility of the people exercising their control upon the courts, or for that matter upon the legislative or the executive branches. He points out that other *rules* have been implemented which attempt to enforce the judge's interpretation of *the law* upon juries, thus usurping their authority and DUTY to judge the facts and the law in determining verdicts. Ralph points out that there is no provision in the Constitution for an oath to be taken by congresscritters, and an *unsworn* congresscritter is only a pretender, completely without authority to legislate. This was noted much earlier in history. In fact, it was noted by the FIRST congress convening under the *authority* of the Constitution. The response was to legislate, to pass a bill, defining an oath to allow them to take their office and function. This pseudo-legislation was duly signed by *the father of our country,* George Washington. Then, while the Bill of Rights was still *under construction,* other bills were voted upon and passed by this congress of no authority (made up largely of lawyers) the OWNERS, and sovereign. The ills and corruption of our nation is apparent to the most casual observer. The cure is simple-- grand and petit (trial) juries, made up of *we, the people,* need only to be aware of, and to assert their inherent authority. However, these juries are so filtered that the few people who are aware of their sovereignty, and thus their authority, and thus their power are excluded. It only takes the knowledge, and then the assertion, of our rightful authority to return this nation to a proper course. This requires courage as well as knowledge. I am sad to say that our people are sadly lacking in both. I have only barely skimmed some of the contents of this fine work.
