A lawyer who was acquitted by a federal court trial jury of Internal Revenue Service accusations he failed to filed income tax returns for two years now is suing several IRS agents over their alleged improper disclosure of his personal information in the case.

A spokeswoman in the office of lawyer Tom Cryer told WND the case was assembled and filed by Cryer between Christmas Day and the end of 2007 and is expected to be placed on the docket in the U.S. District Court for the Western District of Louisiana.

Last summer in federal court a jury voted 12-0 to find Cryer, of Shreveport, not guilty of the IRS allegations. He had been indicted on 2006 on government claims he failed to pay $73,000 to the IRS in 2000 and 2001.

I attended that trial. Tom Cryer doesn't recommend that anyone not pay taxes because the risk of conviction is too great. He said the judge was better than most. Nevertheless, what I witnessed was the judge assisting the prosecution in every way possible including turning over Tom Cryer's and his attorney's notes to the prosecution. The rules state that is privilidged but judges can ignore the rules. That is wrong; it is just the way it is. That allowed the prosecution to avoid traps Tom and his attorney had set.

I don't consider it a trial by jury because so much of the trial the jury is not allow to see. The prosecution can introduce anything or witness they desire; however, the defense was prevent from calling witnesses and was very limited in their testamony. The judge was determined that the jury not learn anything about the law including what Tom Cryer thinks the law in, even though that is permitted by a supreme court ruling.

It appeared that somehow one informed person was on the juror and he must of informed the other jurors.

Absolutely good advice. This is particularly important because attorney Cryer owes the tax, and I suspect that he now knows this. As do most others. But in particular, all attorneys owe the tax because of the privileges of their status and lic.

It is not a trial by jury, per se. The jury in any 'court room' wherein flies the United States Commander-in-Chief flag (gold fringe mounting an eagle on the top), is simply an advisory panel; to the judge, who renders his decision through jury instructions. There have been many instantances where judges have thrown out jury decisions and rendered a new decision 'based on the evidence.'

If you truly wish to understand, I suggest that you look up tribunal in a legal dictionary, and you will find a comprehensive discritption of a present day 'court room' under Roman law.

The judge was determined that the jury not learn anything about the actual bases of the income tax, which is, and always has been, contractual in nature.

This is also why this case, as in the case of ANY decision that goes against what is required to keep the system intact, will never be published, and can NEVER be used/quoted in another case. I posted a through discussion/breakdown about unpublished cases, written by a very informed legal teacher/attorney some time ago.
