This was just reported by Keith Olbermann on MSNBC. The Nevada Supreme Court sided with NBC in excluding Kucinich for the debates.

Kucinich 69% precincts reporting 15,551 votes = 4.05%

In that Daily Kos straw poll yesterday, Kucinich also got 4%. (That despite the fact that Kos has written extremely dismissively of Kucinich.)
