Anyone have actual experience with this in court?

Eric WhoRU of http://wtprn.com advocates this defense and says he used it sucessfully against the IRS in Los Angeles in the 1970s.

There is a guy in southern California who is going to try and use this defense in court; he was charged with being drunk in public (he was not driving, it is not a DUI case). (No, it's not me). If anyone is interested in attending this hearing when the guy will use this defense let me know. I've never seen or heard of this defense actually being used successfully. I think the defense has merit, but don't think it will fly in today's courts. It will be very interesting to see the court's response to this defense. I will be there recording the proceedings, unless they kick me out.

It won't. Just one simple fact will destroy the argument; answer one question from the 'judge.' And yes, I have seen it tried in court; not successfully.

Not one man in 1000, that have throughly studied the info, will be successful. None of them have the experience of the judge, so how are they going to out- talk him?

And besides which, the judge will have been throughly briefed BEFORE entering into the court as to the contracts that the man holds; drivers lic., files income tax, has a social security number, is a vetran, has a mortgage, credit cards, credit files, any loans and etc. etc. Just one contract, bye-bye.

When a man who is honestly mistaken hears the truth, he will either quit being mistaken or cease to be honest.

he's going to use his defense for the 1st time at the arraignment, so i doubt the judge will be prepped to that extent if at all. Do you think having a driver license or SS# legitimately disqualifies this defense? What if he did not volunteer to have a SS.

First off, as to the judge being prepared, all he has to do is ask if the guy has a drivers lic. or a social security number. What is the guy going to do, lie? Is he an employee? Does he work somewhere and is there withholding taken out? Pretty easy to check these things, and nothing will get the guy thrown in jail faster than to lie about it.

As to volunteering for SS; did he use the number.... one time? Like, for credit? To become an employee? End of discussion.

And as to if they are ligitimate contracts that can bind you.... have you ever looked up the relavant laws, AND, followed the law as it 'evolves' through the years? How many riders are attached to it, and, how many other provisions are tied to it? You would be amazed. Believe it.

Let me give you one example. Do you have a bank account? That would be with a Federal Reserve authorized bank, cause there are no longer any others in America. You signed a contract to open that account.

It is interesting, here in México, when a check is deposited into an account, you do not have to sign the back of the check. BUT, in the states EVERY check must be endorsed. Why is that? Because it is another contract. Look at the back of any check; under the endorsement line, or, at the other end of the check, will be some kind of a statement: per the rules of the Federal Reserve.

There are about 10 million pages of such rules now in existance. And, to be safe and legal, YOU MUST BE IN COMPLIANCE WITH ALL TEN MILLION PAGES OF RULES AND REGUALTIONS. Good luck. And this is another contract that binds you to the political apparatus.

Or, you can do I as do, and not have ANY bank accounts WITHIN the United States.

I have seen it done, but that was 15 years ago. Surprisingly to many people, there are those in America who have been raised without birth cirtificates and without any of the garbage of the United States.

Today would it be done? I do not know. There are fewer and fewer that have any undersanding of what constitutes the United States, which means that there are fewer and fewer to watch what the judges do.
