State legislators have passed laws barring illegal immigrants from receiving government services, posting bail for serious crimes and winning punitive damages in lawsuits

the law supposedly barring punitive damage awards is interesting, i had not heard of that and i don't know if it would stand up if challenged. when someone is here, illegally or not, they do have basic rights. for example, which is why police cant arrest an illegal and treat them as it does if they were in gitmo. So, when one concedes that rights dont belong only to ''citizens'', that begs the question if they are damaged why cant they have legal recourse?

are they still entitled to jury trials, and if so on what authority does the state have to barr the jury decision?

what about the expatriots or those born in murika who dont voluntarily claim the title of ''citizen'? are they then barred from punitive damages awards in lawsuits too? On what basis??

I think that is BS and wouldnt hold up for ten minutes if challenged, nor should it.

Not one more dime for this criminal enterprise. Certainly such legal issues wouldn't arise if they followed the legal process to immigrate.

I'm guessing, but I don't think expats have a high expectation of being entitled to squat when they move.

the issues might not arise but id be curious as to if this law could be upheld. for example, one can not hire an illegal and pay them 2 bucks an hour. despite being illegal theyre still entitled, according to the state, with minimum wage laws. this has been ruled on. also, they can not be arrested and carted off without a chance for counsel and read their rights. These are just a few examples of the 'rights' that the states concede are still held by those who break immigration laws.

as far as 'expats', i was refering to those who never left the US and just dont voluntarily claim citizen status. but who still live here,. maybe it's too obscure or small group to discuss, Lol. Eric WHORU on WTPRN.com has a radio show discussing these things. it's interesting. he claims to have beaten a fed. charge in the 70s using this defense, as well as beating driving without a license charge in missouri a few years ago; claiming the courts lack of political jurisdiction.

if i ever meet an illegal alien in arizona who wants to sue someone for punitive damages, ill let you know how it turns out. ;-/

it's just like the cell phone laws here or seat belt laws. if i ever get one i will challenge it on appeal as unconstitutional. then the appeals court would have to rule on it. Basically just challenging the govt on everything. More people should do that.
