Dead Constitution See other Dead Constitution Articles Title: A Quick Fix for Judicial Tyranny I am going to repeat myself here. Not because I am all that great, but because people need to be reminded of enduring truths. It is my calling to apply enduring truths to the shifting sands of the modern world. If this election is like any other, all the predictable people will no doubt be saying something like this: “…We Must Vote Republican And Stand Behind (John McCain) And His Judicial Nominees Because If We Don’t Evil Diabolical Scum Of The Earth Liberal Democrats Will Put Their Activist Judges On The Federal Bench And These Judges Will Perpetuate Judicial Tyranny By Waging A Jihad Against America, Our Christian Heritage And Values, Motherhood, Norman Rockwell, Baseball, Hot Dogs, Apple Pie And Chevrolet By Legislating From The Bench And Imposing Their Radical, Morally Bankrupt, God-Hating, Perverted Secular Agenda On The American People.” Just chill and consider the following: So cease your vacuous blather about the Democrats and the rogue liberal judges they continually bring us. It is a boldfaced lie that the Founders did not foresee the possibility of a runaway judicial branch and failed to make provisions for it. Article 3, Section 2 of the Constitution states: “In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.” (Italics mine.) Hence, Congress has the power to restrict the activity of the federal courts and to put an end to judicial recklessness. And it has been horribly derelict in this duty. For four years, we had a purportedly Christian Republican president, as well as a Republican House and Senate. We hear over and over that it is our Christian duty to support these people. And what did they do to stop activist rogue judges? Not a thing. Not a blasted thing. They didn’t lift a finger. It need not take decades of wishing and waiting and hoping and praying that some Supreme Court decision some day will put an end to decisions like Roe v. Wade. This could happen in a matter of a few days. As House Resolution 300 states, “Supreme Court and lower Federal court decisions striking down local laws on subjects such as religious liberty, sexual orientation, family relations, education, and abortion have wrested from State and local governments issues reserved to the States and the People by the Tenth Amendment to the Constitution of the United States.” HR300, among other things, would remove the ability of federal courts to interfere with state legislation to protect life, thus negating Roe v. Wade. Also, it would likewise forbid federal courts from interfering in other areas forbidden to them by the Tenth Amendment. It ought to be a “values voter’s” dream. Its prime sponsor was – surprise! – Ron Paul. And how did the “Christian” media treat Ron Paul? They treated him worse than that evil, wicked, mean, nasty, liberal media that they say they diametrically oppose. The liberal media – or should I say the America-hating, God-hating liberal media – at least acknowledged Ron Paul’s existence. Time and again, I talk with evangelicals who get their political information from the Christian media such as Denver’s KRKS radio, who have never even heard of Ron Paul. When you tell them that the Constitution contains a quick-fix for a rogue judiciary, they look at you as if you were speaking Swahili. Vince Lombardi is famous for having stopped football practice one day by blowing his whistle and saying that the Packers needed to get back to the basics. He then held up a football and stated, “Men, this is a football.” Ron Paul is doing a wonderful job as the tip of the spear in a movement that is blowing the whistle and saying that we need to get back to the basics. He and his followers – of whom I am most proud to be one – are saying “This is the Constitution.” The Constitution is not a difficult document. Let’s read it. Let’s apply it as written, not as interpreted. And let’s see how fast life in America improves.
