NYers to NYPD: 'I Do Not Consent to Being Searched'

by Chisun Lee
July 21st, 2005 6:36 PM

Reacting to the NYPD's announcement Thursday afternoon that police would randomly—but routinely—search the bags of commuters, one concerned New Yorker quickly created a way for civil libertarians to make their views black-and-white. In a few outraged moments, local immigrant rights activist Tony Lu designed t-shirts bearing the text, "i do not consent to being searched." The minimalist protest-wear can be purchased here, in various styles and sizes. (Lu will not get a cut. The shirts' manufacture, sale, and shipment, will be handled by the online retailer. Lu encourages budget-conscious New Yorkers to make their own and wear them everywhere.)

Police Commissioner Raymond Kelly had announced the legally obvious—that New Yorkers are free to decline a search and "turn around and leave." But Lu, who is a lawyer at Urban Justice Center, warned that even well-intentioned cops could interpret people's natural nervousness or anger as "reasonable suspicion." The possibility of unjustified interrogation and even arrest is real, Lu said.

Although police promised they would not engage in racial profiling, Lu said that, as with all street-level policing, people of color and poor immigrants would be particularly vulnerable, especially if encounters lead to arrests.

NYPD had started the searches this morning. Another good reason not to visit NYC.

I'm listening to CNN. I don't think this is going over very well with the rush hour millions. One NY'er said he now feels he lives in Russia. My question is what will the cops do with the person who refuses to allow them search their property? Will they do it anyway (I smell an ACLU lawsuit) or simply not let that person on the train without a search? If that's the case, in theory, they might be allowing a person suspected of carrying a bomb to simply walk away. If even a few hundred people a day refuse the search, the process stalls. Civil disobedience at its finest.

They are gaining total control of the masses one bombing incident at a time. It will be soon impossible to have anti-government protests in the "interests" of security. Bloomberg doesn't want any more of those embarrassing mass protests in the streets of NYC.

But he's a Republican! (g)

I so remember arguing with the FReepers when he was elected. They were celebrating, while I was calling him a scumbag. I was right, unfortunately.

I just listened to a report on MSM radio about the searches.

Of course, all the people they interviwed were completely for them.

Comments like "They should have done this a long time ago" and "I feel more secure now."

Perfect propaganda for the sheeple to consume en masse.

We're all screwed just because of ignorance.

Bloomberg probably has them looking for Indian Reservation cigarettes too.

I watched a bit of the Patriot Act debate on C-Span last evening.

Ron Paul offered an admendment so that doesn't ever happen and to keep free speech and the right to assemble intact. I don't know if the admendment passed and if it was attached to the P.A. . I know Paul voted against final passage but he would have done that anyway even if his admendment was attached.

So what would you do smart ass? Do nothing because you may hurt someones feelings? My biggest problem with this is that just like the airport searches they will waste their time on old ladies and children. Must not offend our wonderful immigrant population. I am so sick of the elites kissing these peoples ases while not giving a hoot about the rest of us.

It's here now.. What exactly IS a "Free Speech Zone" anyway and where is it mentioned in the Constitution?

A cynical person might call it the "STFU & move three blocks away from the cameras" zone.

So what would you do smart ass?

1) Move the stupid security personnel out of the airports and train stations, relocating them to the border where the searches and checks are more appropriate.

2) Get our military the hell out of all those countries where it does not belong and quit meddling in the domestic affairs of other nations.

3) Start repealing laws that violate the rights of individuals - starting with the Patriot Act.

4) Try George W Bush and his entire administration for warcrimes against humanity, followed by the Clinton administration and work backwards through the ranks until they're all held to account.

That should be a good start.

A good way to eveluate this is to compare your odds of getting killed in a terrorist attack against the odds of having your life jacked around by overly empowered, overly nosey and overly intrusive government.

The way I figure it, we will need a couple of major attacks per day to even begin to even up the odds here.

I just listened to a report on MSM radio about the searches.

Of course, all the people they interviwed were completely for them.

I'm a few miles outside of NYC. THE MSM here is really pushing the disclaimer of 'don't worry, there will be no racial profiling.'

The disclaimer was made yesterday in every report on it immediately. IOW, the MSM was making the issue profiling, and not the actual searches themselves. WABC was particularly bad on this. They would make the statement about racial profiling at the end of their reports- to punctuate. The last statement they make in a report is likely to be remembered more than the statements earlier in the report.

Since all media put such a primary importance on 'no profiling' and the govt is it's biggest proponent, it seems like the media was told to make it a big issue and it loyally complied.

Hearing these reports was surreal. Especially to someone not Muslim. The govt is saying there is a serious risk of young Muslim men bombing mass transit, thus they have to unconstitutionally search people for their own good. But they punctuate the issue with another issue, profiling. So they are saying, openly, that if they are searching 1 out of 30 people, and if the 1st 29 are young Muslim men and the 30th is a 75 yr old white female, they will let all the Muslim men thru and search that 30th woman.

So, i think they are promoting the racial profiling issue to take attention away from the more serious issue. As well as serving the cultural Marxism gods, because, it is NY after all. And they can't be serious about the threat if they consider whites and Muslims to be Marxism like equals, one no more a threat than another. After all, Muslims are an oppressed group and therefore the near 100% likelihood that they would be the participants in an attack must be overlooked, because that would lead to further oppression. The other classes have to endure the threat, because the Marxist doctrine is primary. Negative consequences to 'oppressor' class mean nothing in this doctrine. The police and the govt can't even say that there is a greater risk from Muslim men, so be on the lookout, further weakening everybody's defenses against an attack. I'm only pointing out the hypocrisy above about the searches. I don't think Muslims should be searched either.

Civil disobedience at its finest.

One million march on Capitol Hill. They would just freak out and call in troops. Then, it is all over. All bets off and mass demonstrations nationwide. I will find a way to be there.

The NYers could just tell the cops to take a hike. What are they gonna do? You think they will arrest hundreds of unruly commuters? I don't think so.

I can tell you this from experience BTP, the PD won't be randomly searching folks up in Harlem, or down in Bed Sty. They'll cherry pick some student, bum, or aging Blue hair. All in all it's just another brick in the wall.

Are you reducing important rights to 'feelings', or am I reading this wrong?

Your only concern is that govt will be wasting its time. Sympathy for the State. Interesting.

Your opposition to lack of racial profiling is based on the govt losing something- time, efficiency.

Do you oppose the govt's policy of refusing to profile on any ideological grounds?

You're right, JT. I recall that even the cops are no better than gang bangers in certain situations.

There was a game they used to play back in the neighborhood. A car load of punks from the other gang would cruise around looking to see who they could "scab up" in the alleys or on the streets. I knew a couple of guys who very nearly got their asses kicked after being out late drinking and stumbling home thru the alley.

And I know of a murder or two as well, and one we had a good idea who the perp was because of the word on the street. These jerks were riding around and happened on a fairly inoffensive type of punk (he also happened to be an epileptic) who lived in the hood and hung around with everyone. The jerk who killed him jumped out and hit him in the head several times with a ball bat. He was dead and they got away.

But people do talk and even though the cops could never prove it, everyone knew who was behind it. Even the guy's brother had it out with him for the many things he had perpetrated which made the tension levels rise and a gang war a real possibility. It was some tense times and these people were even looking to kill me for a couple of months for something I had nothing to do with.

There were still some lessons in life to be learned there, and one of the main things was that most of the crap revolved around making money. One guy I knew said when he finally figured this out, and shed the ideas that held everyone else back, he made more money than he ever thought possible, all unlawfully, of course. I told him once that if he devoted his energy to making it in the real world instead of the underworld, he would be wealthy beyond his wildest dreams. He had a good head for business and organization, too bad he was a crook.
