Ruling Set For Obama “Natural Born” Ohio Suit

An Ohio judge is set to rule Friday if a lawsuit disputing the “natural born” status of US Presidential candidate Barack Obama is valid.

The suit, filed by political blogger David M. Neal, is one of eight lawsuits similar to one filed by Philadelphia attorney Philip J. Berg last August. That suit was dissmissed after some questionable legal procedures regarding time frames. Berg is preparing for an appeal to the Supreme Court.

Barack Obama’s “Fight The Smears” website has confirmed that Obama was a Kenyan citizen until 1982. Hawaii governor Linda Lingle sealed access to Obama’s birth certificate Monday. Obama has not yet requested access to it.

Berg is preparing for an appeal to the Supreme Court.

And, he'll learn by their denial of certiorari that the high court has even less tolerance for lawsuits without proper foundation.

Berg didn't even have a sworn deposition from Obama's grandmother to enter as part of his prima facie case against Obama.

And, it's not enough to say, "She told me on the phone that Obama was foreign born!" SHE may be calling from the day room of a hospital for the demon possessed and believe that she hears voices....

Berg is disputing Obama's eligibility to run for President under "natural born" requirements. Berg does not need to bring in hearsay from Obama's Kenyan aunt. Berg has to prove his legal standing to the Court and the injury he sustains if Obama is not forth coming with evidence of his eligibility.

Berg wants the Courts to recognize him and his request to force Obama to produce evidence of his eligibility as "natural born" to run for the Oval Office - ie. Obama's original live birth record - which the Governor of Hawaii has now sealed.

Phil Berg Files Anti-Obama Case in Both the 3rd Circuit and the U.S. Supreme Court October 31st, 2008

On October 30, Philadelphia attorney Phil Berg filed his appeal in Berg v Obama in the 3rd circuit, case number 08-4340. That Court has not acted. Berg then filed with the U.S. Supreme Court, case number 08-570.

The U.S. Court of Appeals Clerk’s office is treating this case in an unusual manner. Normally, when one telephones the Clerk’s office and asks about the status of a case, someone in the clerical staff answers the question. In this particular case, the employees have been told not to release any information, without having the caller speak to one of the attorneys who works in the Clerk’s office.

The case concerns Berg’s assertions that Obama does not meet the constitutional qualifications to be president. The U.S. District Court had ruled earlier this month that Berg lacks standing.

Say what? The Court of Appeals Clerk's Office are all government "employees", whose salaries are paid by US taxpayers. And these gov't employees are being "ordered" to act as obstacles re: providing information on the case and also to not refer taxpayers to one of the attorney's who works in the Clerk's Office? What's wrong with this picture?

Why doesn't the US Attorney General together with the help of the Governor of Pennsylvania immediately suspend the Clerk who gave such orders and send in the PA. National Guard to physically remove the Clerk pending the investigation of the Clerk's unprofessional and unbecoming conduct which would send a pointed message to the government employees working in the Clerk's Office. This is ridiculous. The Clerk's Office exists to serve the taxpayers of the state not to serve the Clerk's whim and political bias.
