Brown asks state high court to overturn Prop. 8

Brown, who is required to defend state laws unless he cannot find reasonable legal grounds to do so, said after Prop. 8 passed Nov. 4 that he would support the initiative before the state's high court.

But in a lengthy filing late Friday, he argued that the constitutional amendment was "inconsistent with the guarantees of individual liberty" in California's governing charter.

Two things here; 1) With all that is wrong in California, gay marriage should be very, very, very low on the list of ills. 2) Why would anyone bother to participate in the process when elected officials sue (in this case the voters in effect) if they don't get a desired result?

Moonbeam is a left wing moron. He is not a very smart lawyer and he's an even more doltish politician. How he got elected AG is incomprehensible to me, even by California wacky standards.

California prohibits certain heterosexual marriages too - close relatives cannot marry; people with diminished mental capacity cannot marry; people under age cannot marry.

So under Moonbeam's interpretation, do these current state regulations barring heterosexual marriage in some instances deprive citizens of "individual liberty" ???? Answer: no because the state has the right to set qualifiers and disqualifiers with regards to whom it issues marriage licenses, just as it does with regards to other areas wherein the state dispenses licenses.

This is much to do about nothing because in California same sex couple who registers as domestic partners has all the same rights and responsibilities as married people for the purposes of state law.
