There Ought To Be a Law…

Have you ever thought that? Ever said it? Of course. We all have. Well, most of us.

This thread shall elicit ideas/thoughts/comments on proposed laws.

If YOU were in charge, what law would you like to see? Could be national, state or, even, local level.

And, we shall assume (which is not necessarily the case now) that the government(s) would actually enforce these laws.

I’ll start.

1) Child(ren) born to an illegal immigrant would NOT be a United States citizen, yet, rather, a citizen of the native country of the mother and the both of them deported thereto upon discovery.

2) Federal Income Tax Form 1040 would be three lines:

Income for year:

Minus $30,000:

Pay 15% of line Two.

The IRS Code would be almost exclusively devoted to what is and what is not income. Any transfer of money, value of services or goods between individuals, entities, companies, corporations, anyone and anything is reportable income. Any transfers in any situation in any amount between immediate family members not to be considered income.

3) There shall be NO foreign aid to NO country EXCEPTING shipment of food, medicine, and goods related to humanitarian relief.

4) In the case a military draft is deemed required by the federal government, all immediate family members (to degree first cousin) aged 18 to 30, male and female, of: a: the federal legislative department; b: the federal judiciary; and, c: the federal executive branch (executive, cabinet level, and GS-18 equivalent and above) SHALL be drafted into active military service BEFORE any other American.

5) No American female shall serve in or near an active combat zone while in American military service.

6) In cases where the death penalty is sought by the prosecution, the burden of proof in the guilt phase shall be “beyond a reasonable doubt”. In the subsequent death penalty phase, the burden on the prosecution shall be “beyond any doubt whatsoever”. After a jury finding of guilt in both phases, the case shall be fast tracked to immediate appellate review by the state’s highest court OR the United States Supreme Court. With affirmation, the death sentence to be carried out within 10 days.

7) In cases of rape, murder, assault and batter of a high and aggravated nature, kidnapping, and armed robbery there shall be no application of ANY early release program by the executive branch upon the sentence passed by the judicial branch.

Instead of time off for good behavior, the standard shall be no extra time for good behavior.

A person convicted and sentenced to life in prison shall die there.

8) Any federal government agency and/or program not in existence prior to 1940 shall be abolished and any responsibilities/oversight of such agencies turned over to the respective states.

9) The legal adult age for drinking shall be 18 years.

10) No one shall be imprisoned for possession/use of any drugs. Drugs use should be considered a societal medical problem and NOT a criminal matter.

11) The American military shall be deployed on America’s borders (arm to arm, if need be) to prevent illegal entry into this country at any point of entry (the border, airports, and other ports of entry) by ANYONE. Legal immigration by productive and law abiding individuals from other countries should be encouraged, yet, heavily regulated.

12) The flat income tax percentage could only be altered by affirmative two-thirds vote of both Legislative Houses and signature of the President.

13) Any governmental authority would be strictly liable to ANY subsequent victim of a crime committed by a person released from custody by that government authority.

14) Jury trials in civil cases would be barred. A three judge panel would decide all civil cases and set damages. A unanimous decision shall not be appealable.

15) The American judicial system shall adhere to this principle: do the right thing.

16) Any and all expenditures by the federal government MUST pass this two-prong test: a) is this expenditure EXPRESSLY authorized by the original words of the U.S. Constitution, and, b) can the treasury afford the expenditure.

17) In criminal trial, the jury system shall stand. However and similar to Great Britian, the system shall be inquisitorial instead of accusatory. The seeking truth shall be the standard. The failure of a defendant to testify shall and will be held against him/her.

18) In civil cases, the loser shall be liable for costs and fess.

19) There shall NO requirement for registration of any type, kind or nature for firearm ownership EXCEPTING persons convicted of major violent felonies and adjudicated mentally ill persons shall not possess or own firearms.

20) Commission of a major violent felony with a firearm shall require a mandatory life sentence.

21) NO foreign government, directly or indirectly, shall be allowed to contact or provide ANY money, gifts or ANYTHING to a member of the American federal government. Any and all contact, requests, or issues shall be directed through the U. S. State Department.

22) American citizens qualified to run for any elected public office MAY spend ANY amount of money in such endeavor. HOWEVER, ALL monies raised from whatever and any source MUST be publicly available to ANYONE requesting such information. Failure to submit such information or concealing same shall be immediate disqualifying.

23) The American federal government SHALL furnish any and all information related to American federal government as may be requested by any American citizen ONLY charging the copying, researching, actual time costs related thereto AND within 7 days of such request. An exemption, of course, shall be made for matters of national security and military interest which could be challenged in an appropriate court (with the loser paying, remember).

I’ll stop for now.

No more victimless crimes.

One term limit for any public official.

All laws must be equally applied to citizens as well as those in government.

No income tax, only a federal sales tax of 7%. Federal, State and local sales tax combined not to exceed 15%

No other taxes period, no sin taxes, usury taxes ad infinitum.

Social security money is completely untouchable except for the person who paid in and in that case they get back what they paid in plus the interest it drew.

Government bonds cannot be owned by anyone who is not a citizen of the USA.

(here is a flamer) If you own a business, you have the right to hire who you want, Allow any legal activity to go on in your business (like smoking) and if it is a private business.....allow only those in that you want in.

Whatever age is deemed responsible enough to kill other humans (military) then that same age is the age at which said person is eligible to engage in all legal activities.

I could go on also but since it is 5:20 or so I must shuffle off to bed. (gotta love night shift)

Bravo! I'd say, as a lawyer, you're a true Constitutionalist.

The only thing I'd add and you might have already covered it, is that only living, walking, talking citizens should be allowed to make political contributions. There ought to be a law against corporate donations.

My new law:

Any legislation that is passed must reference the specific clauses in the relevant constitution(s) granting the power to this level of government to authorize such law. Further, each new law, when enacted, must specify two old laws that will be retired before it can take effect. Lastly, the funding to implement any new law will have an associated line item placed into the budget for funding review each and every budget cycle and no interim funds transfer can be made without a super-majority approval by the voters.

I'd add this: ENFORCE the laws already on the books. Don't pass more to address that failure. This would apply most heavily to GUN CONTROL and ILLEGAL IMMIGRATION.

If law enforcement USED the laws already at their disposal, there'd be no need (for example) for California to decide whether illegals deserved driver's licenses or health care benefits. No need for several states to ban or regulate legal gun ownership for law abiding citizens to stop lawbreakers from breaking laws with guns... AS IF lawbreakers would actually comply with it??? (the ultimate in idiocy... I'm originally from MA aka gun control law capital of the nation...)

I could not disagree more. Poor people do not spend as much on things. They buy food and shelter and those would be excluded just like they are now. If someone only had the money for food and shelter how much would they be taxed????

Just like the politicians fight over how to dispense tax breaks and shelters today, they'll fight over what gets included and excluded from the sales tax and at what rates different things will be taxed.
