Hearing Impaired Man Tased by Police

Donnell Williams had just gotten out of the bath tub, wearing only a towel around his waist, when he turned the corner to see guns pointing right at him.

"I ain't never been so scared," says Williams.

Police forced entry into Williams home while responding to a shooting, but it turned out to be a false call. They had no idea at the time the call wasn't real and that Williams is hearing impaired. Without his hearing aid he is basically deaf.

"I kept going to my ear yelling that I was scared. I can't hear! I can't hear!"

Officers were worried about their own safety because at the time it appeared Williams was refusing to obey their commands to show his hands. That's when they shot him with a Taser.

Deputy Chief Robert Lee of the Wichita Police Department says, "This one occurred on the worst of calls, that being a shooting. The first few minutes getting control of the scene are very, very important."

Once the facts were all sorted out, officers repeatedly apologized to Williams. Police wish it never happened, but with the information they had at the time, their choices were limited.

"Do I wish there would have been some way they were notified in advance this gentleman was hearing impaired? I certainly do. No one is happy with the way it worked out," says Lee.

Williams was not hurt in the incident. Police say the shooting call came from a cell phone but they still don't know who made it or why.

OK. Is everyone in shock (pun intended) or have we all been effectively numbed by these stories? (If you have, that's intentional.) How many more times will this happen before someone gets a clue that "We're not in Kansas anymore?"

I wasn't over the last one where the cops assumed a motorist was uncooperative when trying to remove him from his vehicle so they lit him up only to find that he was diabetic and nearly in a coma.

The M.O. seems to be, "if you fail to follow the command you will be punished and we'll decide later whether it was justified." If not then you had better take steps to inform arresting officers in the future if you don't want it it happen to you again.

Remember, the reason these things keep happening is because it ain't the cops who are suffering. If it was they'd solve the problem with the required policy changes PDQ.

Policies have changed but not for the safety of the pork. A tazer probably comes under the definition of Force in the Texas Penal Code. It can be argued that it should be defined as Deadly Force. Given this...

Let us go back about 25 years and see if officers "choked out" (the most used "Force" at that time) everyone who failed to follow an officer's simplest command. This was usually always seen as improper use of unjustifiable force, especially if used on someone who was not male or who was not young, and who was NOT resisting arrest (you were not seen as RESISTING if you merely failed to follow a command!!!!) and was usually investigated by IA, and was, as tazers have been, responsible for several deaths. In the case of choking, death resulted from crushing and the later swelling of the airway, sometimes even after the complainant was in jail and no longer being observed.

We see a new attitude with tazers. Open season on civilians. "Resisting" has now become "failure to obey ANY order" when it never was before. I can not explain it but it is definitely there. It's now accepted as status quo and acceptable, just as racism against whites is.

I believe it is intentional that we are being fed these incidents in order to "get used to it." We have.

"Resisting arrest" could not be successfully prosecuted 25 years ago by someone merely failing to obey a command. Evidently, it can now, or we have a lot of cops using unlawful force and getting away with it.
