Kansas Man Allegedly Kills Seagull Over Ice Cream
LAGUNA BEACH, Calif

Dragan Djuric, 50, of Kansas City faces animal cruelty charges for allegedly killing a rare seagull with a stick over an ice cream.

A Kansas man has ruffled some feathers in Orange County after allegedly beating a rare seagull to death over an ice cream on New Year's Eve in Laguna Beach.

Dragan Djuric, 50, and his wife were visiting Laguna Beach from Kansas City .

The couple was eating ice cream on the boardwalk when they say two seagulls attacked them, knocking the ice cream to the ground. They allege the rare Heermann's Gulls then started pecking away at them.

"They don't attack us, they're birds. That's crazy," a beachgoer told CBS 2 News.

Djuric told police he had no choice but to protect himself. He allegedly beat one gull to death with a stick and injured a second one, which flew off and has not been found.

Witnesses described the attack not as a gentle shooing, but rather as a violent attack on the birds.

Djuric and his wife did not sustain any bite marks or any evidence that a bird had attacked them, according to detectives.

One resident believes Djuric was angry that the birds were eating his wife's ice cream.

"He was very upset about spending money for ice cream that he didn't get to consume," said Sgt. Jason Kravetz of the Laguna Beach Police Department.

According the Audubon Society, Heermann's Gulls are known for being very aggressive and it is not unusual for them to go after people or objects.

Djuric could not be reached by phone, but he told a Kansas radio station that he has nothing to say. He now faces animal cruelty charges.

The Orange County District Attorney’s office has decided not to press charges against a tourist from Kansas who was accused of beating a seagull after it went after his ice cream Dec. 31 on the boardwalk at Main Beach, D.A. spokeswoman Farah Emami said Tuesday.

someone told me they saw this story on the tv news. the news reported the onlookers made a 'citizens arrest' of the man after he hit the birds. cops then came and cited him for animal cruelty, lol.

When I was about 13 or so I was fishing on Avalon Pier at Nag's Head, NC. As I strolled down to the end of the pier I zero'ed in on a man who spotted a pod of bottlenose dolphins approaching the pier. The man whipped out a blue steel MOD 36 S&W (with a square butt) and began firing in their general direction, even though they were a hundred yards away and under water with the exception of the occasional breach of a dorsal fin or head.

In other words, his chances of hitting one were roughly the same as digging a latrine a striking the Lost Dutchman's gold stash, and it's doubtful that the critters would relate the popping sound with bullets around or even in them. But the stupid shit insisted that "they'll run the fish off" and was oblivious to how foolish and "unwell" he appeared to others on the pier as he emptied his revolver.

This was years before the passage of the Marine Mammal Protection Act (MMPA) of 1972 but today the man would end up in federal court, and in addition to forfeiting the firearm he'd pay crushing fines and possibly end up serving weekends in some correctional facility.

Gulls and shorebirds are also protected, and I'd certainly know better than to swat at them unless they pulled a shank on me. The price of a couple of ice cream cones in CA (about forty dollars apiece at some beaches I guess) would be a bargain at twice the price compared to the costs of hiring a lawyer and paying the fines.

And, even though the state has declined to prosecute the man is still subject to federal charges, even though unlikely. The feds don't like to bother with these things unless they're dealing with a habitual poacher who has thumbed his nose at them in the past and some enforcement agent is adamant about prosecution.

In Virginia, I met an idiot who bragged to me how he shoots hawks and owls on sight because "they kill the game." Maybe he's related to the guy you met on the fishing pier.

i felt sorry for the old guy because i know these damn seagulls can be very agressive. , and i can just imagine the kook socialists who 'turned him in' for swatting away the birds that were attacking his wife. now a few yrs ago in santa barbara my wife and i were on a pier eating lunch and , it's funny now, but a sneaky predatory seagull that had been watching us for some time, DOVE ONTO THE TABLE and violently grabbed the hamburger right out of my wife's hand, thank goodness didnt get any fingers. he then shook the food as if it were prey to kill it, splashing catsup all over his face. (very funny visual there). I shooed him away but the bastard kept coming at us. i got the vinegar squeeze bottle and squirted it at the bastard. Some kook then came up and told me 'do not feed the birds' i told him to f-k off and get away from me. , and that when a bird jumps onto your table and grabs your food you're not 'feeding the bird'. that guy who approached and tried to admonish me, along the others who 'turned in' and 'arrested' this tourist is just illustrative of the sick mind-f-cked KOOK society we live in.

What is really sick is that people can be brainwashed into believing that they are wrong to protect themselves and their family and friends from those who would harm them.
