Lehman judge faces assault charges

U.S. Bankruptcy Judge James Peck who is presiding over the Lehman Brothers bankruptcy case is accused of hitting his wife.NEW YORK (Reuters) -- A New York judge assigned to the Lehman Brothers bankruptcy case was charged early Sunday morning with attempted assault and harassment against his wife, a court spokeswoman said.

U.S. Bankruptcy Judge James Peck was brought to Manhattan criminal court shortly after midnight Sunday and was released without bail, said spokeswoman Alicia Maxey Greene.

Peck's wife, Judith, told investigators Peck struck her with an "open palm" at their Park Avenue apartment, causing "substantial pain" in her jaw area.

A representative at Peck's judge's chambers said there was no comment. A call to the judge's courtroom deputy was not immediately returned.

Peck was assigned to the Lehman Brothers Holdings Inc. case in September, after the investment bank filed the largest bankruptcy case in history, listing more than $600 billion in liabilities.

Peck, a native New Yorker, was sworn in as a bankruptcy judge in Manhattan in 2006. Prior to that he was co-chair of the business reorganization department at Schulte Roth & Zabel in New York and a partner at Duane Morris LLP in Philadelphia.

He has degrees from Dartmouth College and New York University School of Law.

Peck is due in court on March 16. He faces a maximum sentence of 90 days in prison.

The court's circuit executive was not immediately available to discuss how the charges would affect Peck's judicial duties.
