Update (1645ET): Just hours after the deadline for the petition's deadline, The U.S. Supreme Court has rejected a request by Trump ally Mike Kelly, a Pennsylvania Republican, to nullify Joe Biden’s election victory in Pennsylvania.

Kelly argued that virtually all of the state’s mail-in ballots were unlawful.

The rebuff came without explanation and with no noted dissents.

NOTE - This case is different from the voter fraud lawsuit against PA, MI, and WI, that was filed by the state of Texas this morning...

Update (1515ET): Just twelve hours after it was filed, the US Supreme Court has officially put Texas's lawsuit against Georgia, Michigan, Pennsylvania and Wisconsin on the docket, meaning the case will be heard.

Update (1006ET): The state of Pennsylvania has replied to the Texas lawsuit, arguing that it doesn't actually address Act 77 - a 2019 statute which allows voters to cast mail-in ballots for any reason.

Pennsylvania also argues that Texas doesn't articulate how 'massive disenfranchisement' of voters by tossing out the results of the election 'would accord with the Due Process Clause, which requires the counting of votes cast in reasonable reliance on existing election rules,' and that the case at hand wouldn't result in a 'circuit split' - when two or more different circuit courts of appeals might rule differently on the same legal issue (and is one of the factors the Supreme Court uses when deciding to take cases).

PA is also arguing that Texas, or anyone, has had since 2019 to object to Act 77, which violates the 'doctrine of laches.'

The state of Texas filed a lawsuit at the US Supreme Court against Georgia, Michigan, Pennsylvania and Wisconsin on the grounds that various changes to their voting rules or procedures - either through the courts or via executive actions - violated the Electors Clause of the Constitution because they did not go through the legislatures.

Texas also argues that differences in rules and procedures in different counties within the same state violates the Constitution's Equal Protection Clause, and that "voting irregularities" occurred in these states as a result.

The lawsuit, filed shortly before midnight on Monday, asks the Supreme Court to allow their legislators to directly appoint electors, according to Breitbart.

Certain officials in the Defendant States presented the pandemic as the justification for ignoring state laws regarding absentee and mail-in voting. The Defendant States flooded their citizenry with tens of millions of ballot applications and ballots in derogation of statutory controls as to how they are lawfully received, evaluated, and counted. Whether well intentioned or not, these unconstitutional acts had the same uniform effect—they made the 2020 election less secure in the Defendant States. Those changes are inconsistent with relevant state laws and were made by non-legislative entities, without any consent by the state legislatures. The acts of these officials thus directly violated the Constitution.

This case presents a question of law: Did the Defendant States violate the Electors Clause by taking non-legislative actions to change the election rules that would govern the appointment of presidential electors? These non-legislative changes to the Defendant States’ election laws facilitated the casting and counting of ballots in violation of state law, which, in turn, violated the Electors Clause of Article II, Section 1, Clause 2 of the U.S. Constitution. By these unlawful acts, the Defendant States have not only tainted the integrity of their own citizens’ vote, but their actions have also debased the votes of citizens in Plaintiff State and other States that remained loyal to the Constitution.

Texas was able to approach the Supreme Court because Article III grants it status as the 'court of first impression' where it has original jurisdiction, such as when two states are in dispute, according to the report.

Not over yet. There are several other lawsuits going apart from Texas. Texas will be heard. The other lawsuits might have been better for the Court to hear. The 9 to 0 decision means a lot. Even the conservatives on the court voted against this lawsuuit. I don't have a TV but I am certain all of the networks including FOX will run with this decision and spin towards Biden.

Unfortunately, I don't see how Texas has any standing to sue other states for how they choose their electors even if they did so fraudulently. I think that's how the USSC will see it.

Is the PA suit the one where they challenged the lawfulness of mail-in ballots? If so, it may have been thrown out just because it should have been argued before the election, not after.

I expect the USSC will rule as a unified body without any published dissent to avoid politicizing the court (any more than it already is). They did that in 2000 with Bush/Gore also.

Hate to say it but it's not looking good for the home team at all. Seems the best we can hope for is for myriads of lessons to be learned about how untrustworthy the elections are, with millions of angry Trump supporters doubting anything and everything government.

There is also a silver lining, at least, that the dollar is likely to crash within the next 4 years and Trump won't be blamed for it. That will fall to Biden &/or Harris.

The Texas suit would have ben rejected if it had no merit. The Pa suit was not the main lawsuit for that state. Other suits have to be heard.

Then the state legislatures can still select the electors.

And the House can still elect the President.

If the method for changing the election rules was agreed upon between the States and the FEDS in the document (Constitution) which actually gives life to the system itself, then it does matter and it will be dealt with appropriately. (It's their contract and has been deviated from but I never am surprised at how well these justices speak out of both sides of their mouths).

Aside from the SCOTUS this tampering is a problem even if it occurs in a manner that wouldn't over turn the election. That's not the case this election cycle and everyone knows it. This time the left has raped, robbed, murdered, and sliced up the body to get JoKe Biden the vision in his empty head that he is "President Elect"!

I think it's a problem when party politics outweigh good judgment. The problem is that the entire FEDERAL system has lost the faith of the people that are somehow supposed to show their consent to be governed by those "THEY" legally and responsibly elect. The FEDS have become so aloof that no one believes they have a voice "UNTIL" Trump comes along and actively strives to address as many "people" issues as possible and other issues pertinent to solving the disregard the FEDERAL Govt. has shown for the people for as long as I can remember.

The democrats have fucked with the wrong guy. He has a duty and an obligation by his oath of office to do all he can to resurrect (protect, defend, and support the Constitution) the dead FEDERAL Goliath. I am getting old and am fucking tired of hearing the slop that comes out of D.C. telling me what words I must not use to describe societies deviants and ne'er do wells, who my friends and employees have to be, when I can leave the house, when I can go back to work, when I have to wear a mask or get vaccinated ... and that I have to pay tribute to these self centered assholes is beyond belief to me. Who the fuck do these people think they are anyway ? How fucking stupid do they think my half of the adult population is that we'll always follow the FEDERAL Pied Piper of perversions off of the cliff and into the abyss.

Even if it comes down to bearing arms against these miscreants that's alright because no one could ever claim we didn't patiently wait for a long train of treasonous events to negatively impact our lives and destroy the freedom and liberty that once was the envy of the world.

And one more thing, (probably not) all of the self pitying cry babies that have somehow convinced the lawmakers that their vote is more important than the vote of hard working people raising good kids that will grow up and hopefully have a chance to provide a better life for their children and grand children without having the anchor babies and welfare abusers dragging them down. (Right now I have let out a violent scream). Thinking about these low-life leeches pisses me off because as I see it we have the scumbags of our society at both ends, the least likely to succeed, and the elites on the other end laughing, drinking, and smoking whatever they smoke at their gatherings over the fucking they've been giving the middle class hard working people that pay their fucking bills.

OK, that's it, I've raised my blood pressure past the danger zone and hope I don't run into some pervert trying to enter the little girls bathroom on my way to work.

EDIT: I wanted to add that many Territories have entered the FEDERAL Union after the Constitution was established and are required to agree to established legal policies and principles for Statehood to be granted. I hope for once in my lifetime the government takes the lifesaver before the last bastion of freedom on earth drowns in its self made cess pool.

After being a Trump voyeur for the last 4 years I have learned to wait like he does for the perfect moment to unleash the Kraken ! Ha !

It could be that Trump is attempting to use a net to sweep up all the fishes and swamp creatures by even allowing the Supremes to stick their toes into the water, before he declares martial law under a National Security Emergency. I think he has set the trap by invoking National Security Memorandum 57 (Instituted by Kennedy "57" years ago but never activated until now) and through issuance of the E.O from September 2018 declaring the "whirlwind" of damages that will be suffered by those foreign entities and others complicit with them in interfering with U.S. Elections. (Or lying to persuade the public about the election).

Then he fires a couple of alligators and replaces them with patriots, drags the DCI of the CIA to Germany where his boys have a shootout with the CIA in order to recover the server farm utilized by insurrectionists and traitors after pardoning Flynn who likely had some inside dope on Dominion and Smartalec (I know it's smartmatic) algorithmic moves to steal the election.

Personally, I think the Supremes should jump ahead of the bullshit dog and pony show and simply say, you dumbasses screwed the pooch so sit down and shut up. It don't take a rocket scientist or a Supreme Court Justice to see what Ray Charles can see ... and he's blind and dead ... but probably voted !

No. The court is too busy. Most lawsuits are dismissed before they get heard there. What they do is wait until they find case that meets their guidelines and then they take that and give a ruling.

I am saddened and angry to see the illegal actions taken by the Dems to put Biden in office. On the other hand I was uplifted by the many normal people that rallied for Trump and America. If there were something akin to an arm wrestling contest between the (REAL) Biden people and the Trump people, Biden's group would likely forfeit for lack of participants.

I won't ever give up on a return to sanity and normalcy because the alternatives are unacceptable. And if America is dying I couldn't think of a better opportunity to share the fate of the country I love despite some serious shortcomings during my lifetime.

If Trump can pull this out and I think he can do so but he would have to put martial law into play and start arresting deep state players by the dozens, shut down the mainstream media, impound the assets of everyone complicit to any extent interfering in the U.S. Election process as described in the Trump E.O. of Sept. 2018.

If Trump hasn't asked Barr to chill until the election was corrupted so the military could sweep up the majority of treasonous criminals and subversives. At that junction I'd like to see Sydney Powell reading Barr and Durham their rights while General Flynn put them in chains.

It's not over yet and sometimes one must hit the bottom before being able to recover.
