She is a war casualty. Given Russia and Ukraine are at war, assassinations between the countries are fair game, even if the assassins missed their intended target. In WW1, Ferdinand was assassinated outside of formal war.

But escalation has always been a risk. If Poland decides to send "peace keeping" troops into western Ukraine, things could get real interesting.
